1. Who we are
This Privacy Policy explains how Roadster (“we,” “us,” or “our”) collects, uses, discloses and protects personal information when you visit preorder-roadster.us (the “Site”), request a reservation for the Roadster Series One, or otherwise interact with us.
We are the business (or “controller”) responsible for your personal information. You can reach us at [email protected].
2. Scope
This policy applies to personal information we collect through the Site, through reservation and deposit processes, and through email and other communications linked to this policy. It does not apply to third-party websites or services we link to, which have their own privacy policies.
If you later sign a vehicle purchase agreement, additional privacy notices may apply to that transaction (for example, financing or registration notices required by law).
3. Information we collect
Information you give us
- Contact details and identifiers: first and last name, email address, phone number (optional) and ZIP code.
- Reservation details: the configuration you choose (paint, wheels, transmission, package), estimated price, reservation number, and your place in the reservation queue.
- Deposit and payment details: deposits are processed by a third-party payment processor. We do not receive or store your full card number. We receive limited information such as the payment status, amount, card brand, the last four digits of the card and a transaction ID.
- Communications: messages you send us, your communication preferences and whether you have opted in to product news.
- Privacy requests: information you provide when you exercise your privacy rights, including information needed to verify your identity.
Information collected automatically
- Device and usage information: IP address, browser type and version, operating system, referring page, pages viewed, and the date and time of your visit, collected in our hosting provider’s server logs.
- Approximate location: city- or region-level location inferred from your IP address. We do not collect precise geolocation.
- Cookies and similar technologies: see Section 6 and our Cookie Policy.
Information from other sources
- Our payment processor, confirming whether a deposit or refund succeeded.
- Fraud-prevention and security services, to help detect fraudulent or duplicate reservations.
We do not intentionally collect sensitive personal information (such as Social Security numbers, driver’s license numbers, precise geolocation, or information about health, race or religion) through the Site. Please do not send it to us.
4. How we use information
We use personal information to:
- Create and manage your reservation, including your place in the queue and your configuration.
- Send you a secure deposit link, process deposits and refunds, and keep financial records.
- Contact you about your reservation, order invitations, delivery planning and changes to the program.
- Plan production and delivery, including understanding demand by state.
- Send product news, if you opted in. You can unsubscribe at any time.
- Respond to your questions and requests, including privacy requests.
- Operate, secure and improve the Site, and detect and prevent fraud, abuse and security incidents.
- Comply with legal obligations, enforce our terms, and establish or defend legal claims.
We may create aggregated or de-identified information that does not identify you. We maintain and use de-identified information only in de-identified form and do not attempt to re-identify it, except as permitted by law.
5. How we disclose information
We disclose personal information only as described below:
- Service providers and processors that act on our behalf under contracts limiting their use of your information — for example, website hosting, form processing, email delivery, payment processing, customer support tools, fraud prevention and, if you consent, analytics.
- Licensed dealers or delivery partners, if state law requires a licensed dealer to complete the sale or delivery of a vehicle in your state. This happens only if you choose to move forward with an order.
- Legal and safety: to comply with law, legal process or lawful government requests; to protect the rights, property or safety of us, our customers or others; and to enforce our agreements.
- Business transfers: in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business, subject to this policy’s protections.
- With your consent or at your direction.
7. How long we keep information
We keep personal information only as long as needed for the purposes described in this policy, unless a longer period is required or permitted by law. In general:

8. How we protect information
We use administrative, technical and physical safeguards designed to protect personal information, including encryption in transit (HTTPS), access controls and vendor due diligence. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we learn of a security breach affecting your personal information, we will notify you as required by applicable law.
9. Your choices
- Marketing emails: use the “unsubscribe” link in any marketing email, or email us. We will still send messages about your reservation.
- Cookies: choose “Cookie settings” in the footer at any time, or adjust your browser settings.
- Sale/sharing and targeted advertising: opt out on Your Privacy Choices or turn on Global Privacy Control in your browser.
- Phone: providing a phone number is optional. We use it only to coordinate your reservation and do not send marketing text messages.
10. Your US state privacy rights
Depending on where you live, you may have the following rights regarding your personal information. Residents of California and of other states with comprehensive consumer privacy laws (for example Colorado, Connecticut, Delaware, Oregon, Texas, Virginia and others) generally have these rights, subject to exceptions in the law:
- Right to know / access: to confirm whether we process your personal information and to learn the categories and specific pieces we have collected, the sources, our purposes, and the categories of third parties we disclose it to.
- Right to a copy (portability): to receive your personal information in a portable, readily usable format.
- Right to delete personal information we collected from or about you.
- Right to correct inaccurate personal information.
- Right to opt out of the sale or sharing of personal information, targeted advertising, and profiling in furtherance of decisions with legal or similarly significant effects. (We do not engage in such profiling.)
- Right to limit the use of sensitive personal information. (We do not use sensitive personal information for purposes that would require offering this right.)
- Right to non-discrimination: we will not deny you service, charge you a different price, or change your place in the reservation queue because you exercised a privacy right.
How to make a request
Submit a request on Your Privacy Choices or email [email protected]. We will confirm receipt within 10 business days and respond within 45 days. If we need more time (up to another 45 days), we will tell you why.
Verification
To protect you, we verify requests to know, delete and correct by matching information you provide (such as your name, email address and reservation number) with information we hold, and we may email you a confirmation link. We do not need to verify opt-out requests, but we may deny one we believe to be fraudulent.
Authorized agents
You may use an authorized agent to make a request. We may ask the agent for proof of your signed permission and may ask you to verify your identity directly, unless the agent holds a valid power of attorney.
Appeals
If we decline your request, you can appeal by replying to our decision or by emailing [email protected] with the subject “Privacy appeal.” We will respond to appeals within the time required by your state’s law (generally 45 or 60 days). If we deny your appeal, you may contact your state attorney general.
11. Additional information for California residents
This section supplements the rest of this policy and serves as our notice at collection under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”). In the preceding 12 months, we collected the following categories of personal information:

We do not knowingly sell or share the personal information of consumers under 16 years of age.
Shine the Light. California residents may request information about our disclosure of personal information to third parties for their own direct marketing purposes. We do not make such disclosures.
Financial incentives. We do not offer financial incentives in exchange for personal information. A reservation deposit is not a financial incentive.
12. Nevada residents
We do not sell “covered information” as defined in Nevada Revised Statutes Chapter 603A. You may still submit an opt-out request to [email protected], and we will record it.
13. Children’s privacy
The Site is not directed to children under 13, and we do not knowingly collect personal information from them. You must be at least 18 to place a reservation. If you believe a child has given us personal information, contact us and we will delete it.
14. Visitors outside the United States
The Site and reservation program are intended for residents of the United States. If you access the Site from elsewhere, your information will be processed in the United States, where data protection laws may differ from those in your country.
15. Third-party links
The Site may link to websites and services we do not control. We are not responsible for their privacy practices. Please review their policies before providing personal information.
16. Changes to this policy
We may update this policy from time to time. We will post the updated version on this page and change the “Last updated” date. If we make material changes, we will provide additional notice, such as an email to reservation holders, before the changes take effect.
